Former French Prime Minister François Fillon has formally abandoned his appeal against his conviction in the “Penelopegate” scandal, bringing the long-running legal saga to a definitive close. The decision, confirmed by a judicial source on Monday, February 16th, follows a ruling by France’s Court of Cassation on January 9th.

Fillon had previously challenged the June 17th, 2025 decision by the Paris Court of Appeal, which sentenced him to a four-year suspended prison sentence, a fine of €375,000 and a five-year ban from holding public office. His wife, Penelope Fillon, also withdrew her appeal. The Court of Cassation’s ruling effectively ends the legal proceedings, allowing the original sentence to stand.

The case, which erupted during the 2017 presidential campaign, centered on allegations that Penelope Fillon received undue payments of approximately €813,440 between 1988 and 2013 for roles as a parliamentary assistant to her husband and his successor, Marc Joulaud, despite evidence suggesting she performed little to no actual work. Two of the couple’s children, Charles and Marie Fillon, were also found to have received payments for similar positions.

The scandal severely damaged Fillon’s presidential bid, ultimately contributing to his elimination in the first round of the election, which was won by Emmanuel Macron. The initial investigation was launched following a report in the satirical weekly Le Canard enchaîné on January 25th, 2017, which first brought the alleged misuse of public funds to light.

A Complex Legal Journey

The current outcome represents a culmination of a complex legal process. Fillon was initially sentenced to a more severe punishment on May 9th, 2022, by the Paris Court of Appeal: four years in prison, with one year to be served, alongside the same fine and a ten-year ban from public office. However, the Court of Cassation partially overturned that decision in April 2024, ordering a new trial specifically regarding the severity of Fillon’s sentence – while upholding his conviction for embezzlement of public funds.

Penelope Fillon’s involvement was also subject to legal scrutiny. While she was not part of the latest sentencing trial, her two-year suspended prison sentence and €375,000 fine, handed down in 2024, remain in effect. Her appeal focused solely on the issue of damages, and restitution.

The Court of Cassation’s decision to uphold the conviction, despite ordering a resentencing, underscored the gravity of the offenses. The initial, harsher sentence had raised questions about the potential for imprisonment, but the subsequent ruling allowed Fillon to avoid the use of an electronic monitoring bracelet – a possibility that had been considered following the 2022 appeal court decision.

The “Penelopegate” affair exposed a vulnerability in the French political system, raising concerns about the oversight of parliamentary allowances and the potential for abuse. François Fillon, a conservative politician who served as Prime Minister under Nicolas Sarkozy from May 2007 to May 2012, had consistently maintained his and his wife’s innocence, asserting that Penelope Fillon had performed legitimate constituency work. However, the courts ultimately rejected these claims, finding sufficient evidence to support the charges of embezzlement and misuse of public funds.

The finality of the Court of Cassation’s decision marks the end of a chapter in French political history. While Fillon’s political career is effectively over, the “Penelopegate” scandal continues to serve as a cautionary tale about the importance of ethical conduct and transparency in public life. The case also highlights the role of investigative journalism in uncovering wrongdoing and holding those in power accountable.

The five-year ban from holding public office prevents Fillon from running for any elected position until February 16th, 2030. He has previously described the ban as a “moral wound,” expressing his belief that the treatment he received was “somewhat unusual” and potentially linked to his candidacy in the 2017 presidential election.
