He wrote his house in his wife’s name so that his nephew would not inherit

Firstly :

It is understood from the question that your father wrote the house in your mother’s name in order to prevent his nephew from inheriting, and therefore your mother advised you to return the rights to her family, and the answer will be based on that.

secondly :

It is not permissible for anyone to prevent an heir from the share that God has given him, by any trick, as in the picture mentioned in the question. God Almighty divided the inheritances, and gave each heir his share. Then God Almighty said: (Those are the limits of God. And whoever obeys God and His Messenger, He will admit him to gardens that Beneath it are the rivers; they will abide therein, and that is the great victory Degrading) An-Nisa/13-14.

This is a severe threat to whoever violates God Almighty’s inheritance allocation.

The scholars of the Permanent Committee for Issuing Fatwas were asked about someone who wrote a third of his property to his wife, and the other third to his daughters, so that none of the heirs would dispute his daughters.

They replied:

It is not permissible for a person to take the form of a transfer contract for his money to deprive some of the heirs. God Almighty is aware of every servant’s intention and purpose, and we warn you not to follow a path that will cause you to be tortured.

Tawlej: It is when a person transfers his wealth from his ownership during his lifetime, in order to prevent some of the heirs from inheriting.

They were also asked about someone who wanted to deprive his son of inheritance because of his disobedience, and they answered:

“You do not have the right to deprive your child of the legal inheritance, because God Almighty is the one who imposed the inheritance on him, and you do not have the right to waive what God has imposed.

secondly :

If a man dies, he leaves behind a wife, six daughters, and a nephew [= ابن عم البنات]If he leaves a house, the estate is divided as follows:

The wife gets one-eighth, according to God Almighty’s saying: (And if you have a child, then they get one-eighth of what you leave behind) An-Nisa’/12.

And for the daughters two-thirds, according to the Almighty’s saying: (And if there are more than two women, then for them is two-thirds of what he leaves) (An-Nisa’/11).

And to the son of the remaining brother, according to the words of the Prophet, may God’s prayers and peace be upon him: “Attach the duties to those who are entitled to them, so whatever remains goes to the first male relative.” Narrated by Al-Bukhari (6732) and Muslim (1615) from the hadith of Ibn Abbas, may God be pleased with them both.

When dividing the estate: the house is divided into 24 equal parts.

The wife has 3 parts.

For girls, 16 parts.

And for the nephew: 5 parts.
