Mobilization in Ukraine 2024 – where subpoenas can be issued during war

In early February, the Verkhovna Rada voted to extend martial law and general mobilization in Ukraine. Now they will last until mid-May.

Lawyer Marina Bekalo, in a commentary on the TSN.ua website, told where subpoenas can be served.

Resolution of the Cabinet of Ministers No. 1478 provides for the delivery of subpoenas to those liable for military service under their personal signature at the place of residence (clause 32 of the Resolution).

Notification may also be provided through the employer. In this case, the latter undertakes to notify his employee by issuing an appropriate order at the enterprise, institution, organization, serve the employee with a summons to the TCC SP, ensure his appearance and report to the TCC SP on the implementation of all measures to notify the employee (clause 47 of the Resolution).

Subpoenas can also be served on the streets and in public places.

The lawyer emphasized that the current legislation does not grant the authority to representatives of the TCC SP to forcibly deliver citizens to the TCC SP through physical pressure, coercion, etc.

“The powers of representatives of the TCC SP regarding the procedure for notifying about a call to the TCC SP are limited solely to the delivery of a summons or mobilization order. This means that such violent actions by representatives of the TCC SP can be qualified as abuse of power, forced disappearance or illegal imprisonment or kidnapping, which, of course, will have criminal consequences,” she explained.
