Maracena, Granada – In a scene charged with raw emotion, Juana Rivas’s 11-year-old son, Daniel, made a desperate plea as he was handed over to his father, Italian national Francesco Arcuri, on Tuesday. The handover, mandated by court order, took place at a designated meeting point in Maracena, Granada, following the Constitutional Court’s decision to dismiss Rivas’s request for precautionary measures to suspend the child’s delivery.
A Child’s Anguish at the Forefront
Minutes after the Constitutional Court’s ruling, Daniel, visibly distressed, expressed his profound reluctance to reunite with his father. Witnesses reported the young boy crying and stating, “I can’t come back.As I will kill me.” This heartbreaking declaration underscored the deep emotional turmoil surrounding the custody arrangement.
Following this initial outburst, Daniel, along with his mother and brother, entered the meeting point. According to Paqui granados, an advisor to Juana Rivas, the child continued to cry and scream inside. However, arcuri’s defense, in an interview with RTVE, countered this, stating that it was Juana rivas whose voice was heard.
Allegations of Parental Manipulation
Enrique Zambrano, a lawyer representing Arcuri, commented on the situation, suggesting that the child’s behaviour was being influenced. “I can tell that because I was talking to Francesco,” Zambrano stated. “And, actually, they have taken it. He has played his role, as always.I know that the character is very attractive, but it is repetitive. And the problem is not that. The problem is the damage you are doing to your child for eight years.”
The Road Ahead: Italy and Legal Battles
After the reunion, Arcuri is expected to travel with Daniel to Italy. Throughout the process, they were accompanied by Sandra Gómez de Garmendia, the General director of Inference and Adolescence Rights, and members of the Juana Rivas and 25N/8M support platform. A team of psychologists and social services was also present to ensure the exchange occurred as smoothly as possible under the circumstances.
Following the handover, Juana Rivas reportedly experienced an episode of nerves and had to be attended to by ambulance, as confirmed by her lawyer. Her support network has appealed for respect for both the child and the mother during this challenging period.
It is indeed critically important to note that Francesco Arcuri is scheduled to stand trial on September 18th in cagliari, Italy, for alleged abuse against his two children. This trial follows a complaint filed by Juana Rivas’s defense.
