A little over a year into his second presidency, Donald Trump has yet to transform America into a full-blown authoritarian state – but not for lack of trying. The past twelve months have been marked by a consistent pattern: the administration proposes actions that push the boundaries of presidential power, and a combination of legal challenges, societal pushback, and, occasionally, internal constraints force a retreat.

Early in his second term, concerns centered around potential abuses of power, including politically motivated prosecutions, suppression of dissenting voices, and the deployment of federal force in Democratic-run cities. These fears, as it turns out, were not unfounded. The administration has pursued all of these tactics, yet has consistently met resistance.

This week offered a particularly stark illustration of this dynamic. The Justice Department’s attempt to indict six Democratic lawmakers for simply encouraging military and intelligence personnel to refuse illegal orders backfired spectacularly. The lawmakers – including Senators Mark Kelly and Elissa Slotkin – had released a video warning against threats to the Constitution originating from within the United States. The timing followed reports that Defense Secretary Pete Hegseth allegedly ordered the military to take potentially unlawful actions against a Venezuelan fishing boat.

The administration, seemingly interpreting the Democrats’ message as a challenge to authority, sought to prosecute them, with Trump himself publicly calling for their execution on social media. However, a grand jury refused to issue indictments, a rare rebuke of the prosecution’s case. This outcome underscores a crucial point: while the administration is willing to weaponize the legal system, It’s not always successful.

This isn’t an isolated incident. Attempts to prosecute former FBI Director James Comey and New York Attorney General Letitia James have also been dismissed by the courts. Even the investigation into Federal Reserve Chair Jerome Powell, ostensibly aimed at exerting pressure, has yielded no concrete results. The pattern suggests a willingness to pursue politically motivated investigations, but a consistent inability to secure convictions or achieve desired outcomes.

Another example of this push-and-pull involves the deployment of the National Guard. In 2025, the administration authorized the federalization of National Guard troops to respond to protests against ICE functions, effectively allowing for the military to be deployed anywhere dissent might arise. This move was met with legal challenges and ultimately led to the withdrawal of federalized troops from U.S. Cities earlier this month.

The administration’s attempts to control the narrative have also faced resistance. Efforts to pressure Disney into removing comedian Jimmy Kimmel from the airwaves were thwarted by a potential boycott from entertainment unions and Disney+ subscribers, leading the network to reinstate Kimmel. Similarly, the case of Border Patrol agent who fatally shot Alex Pretti in Minnesota sparked outrage and calls for an investigation, ultimately forcing the Justice Department to open a probe.

Even in areas where the administration has achieved some success, such as restricting the rights of immigrants, there have been setbacks. The deportation of Kilmar Abrego Garcia, a Tufts student, was ultimately reversed after legal challenges. The administration’s attempts to suppress dissent and control information have consistently encountered obstacles, demonstrating the resilience of American institutions and civil society.

However, it’s crucial to avoid complacency. The administration has successfully purged the Justice Department of career prosecutors and replaced them with loyalists, potentially compromising the integrity of future investigations. The judiciary is also becoming increasingly conservative, which could lead to more favorable rulings for the administration in the future. The recent wave of judicial appointments ensures a lasting impact on the legal landscape.

The current situation can be characterized as a constant struggle between the administration’s authoritarian impulses and the forces defending democratic norms. While the administration has not yet succeeded in fundamentally altering the balance of power, its actions pose a significant threat to the rule of law and civil liberties. The fact that these attempts are being resisted, however, offers a glimmer of hope. The state of the union remains deeply troubled, but the resilience of American society suggests that a complete descent into authoritarianism is not inevitable.

As Human Rights Watch noted in its February 4, 2026 report, the global human rights system is under threat from the Trump administration, alongside China and Russia. The report calls for a strategic alliance of rights-respecting democracies to preserve the rules-based international order. The challenges are immense, but the fight for democracy continues.
