Card industry temporarily holds bills to purchasers of merge point installments

According to the card industry on the 2nd, major card companies such as Shinhan Card, KB Kookmin Card, and Samsung Card have deferred installment payment for members who apply for the right to defend the installment payment.

Installment defense is the right to not pay the remaining installments to the credit card company when a credit card holder has paid more than 200,000 won in installments for 3 months or more, but the merchant closes the business or refuses to justify the cancellation request.

For example, if you paid for a one-year gym membership in 6 month installments, but after 2 months the gym went bankrupt and you were unable to attend, you do not have to pay the rest of the installment payment if you exercise your right to installment defense.

In the early stages of the Merge Point incident, some credit card companies generally refused to accept the case, arguing that it did not meet the requirements for installment defense.

However, as refunds were delayed and some e-commerce companies started to refund, the trend in the credit card industry changed to deferment of installment payments.

A KB Kookmin Card official said, “From the beginning of the situation, for members who want to exercise the right to defend the installment payment, we have withheld the remaining installment claim until a final decision is made.”

If the selling merchant or electronic payment agency (PG) does not accept it, the card company will resume payment in installments to the member or bear losses.

Another industry official predicted, “If you look at the past cases of ‘transparent dentistry’ in Apgujeong, it is unlikely that the right of defense will be accepted.”

Transparent dentistry received orthodontic fees in advance at a low price, but in May 2018, the treatment was stopped, resulting in a large number of victims. At that time, the Fair Trade Commission stated that the transparent dental case could exercise its right of defense under the Installment Transaction Act, and credit card companies accepted this opinion and did not claim the remaining installments from the victims.

The card industry is monitoring the opinions of the financial authorities and the Fair Trade Commission while reviewing whether the Merge Point incident meets the requirements for exercising the installment defense right.

The Financial Supervisory Service is also examining whether the Merge Point case meets the requirements for exercising the right to defence in installments.

The Fair Trade Commission, which had expressed an opinion on transparent dentistry, reacted cautiously.

An FTC official said, “It is not a matter for the administrative department to interpret authoritatively whether it is a right of defense or not.

An official from the card industry said, “The exercise and acceptance of the right of defense is a matter for the holder, card company, and merchant to decide, but the government’s policy will eventually act as a guideline.”
