INE orders to remove posts on Facebook due to political gender violence

In an extraordinary session, this Saturday, March 30, the Complaints and Reports Commission of the National Electoral Institute (INE) ordered to remove posts on Facebook due to possible Political Violence against Women on Gender Reasons (VPMRG).

Three of these for the probable improper use of the guideline, anticipated campaign events and violation of the principles of impartiality and equity within the framework of the 2023-2024 Federal Electoral Process, respectively, as well as a request for an extension of compliance with the precautionary measure.

GOVERNMENT PROPAGANDA

Likewise, it was ordered to modify or eliminate “mañanera” on March 21, since the representative of the National Action Party (PAN), before the Local Council of Oaxacadenounced that it is government propaganda, which violates articles 41 and 134 of the constitution.

Furthermore, it was considered appropriate to issue precautionary measures, under the aspect of preventive protection, so that the President of the Republic refrain, under any form or format, from making statements, issuing comments, opinions, or accusations related to government achievements, actions or programs, as well as disseminating government propaganda that does not fall within constitutional and legal exceptions.

On the other hand, after the Party of the Democratic Revolution (PRD) denounced various public officials, a candidate for the Presidency of the Republic, as well as the Morena, Labor (PT) and Green Ecologist parties of Mexico (PVEM), for the publications of a press conference in the social network X and the digital platform TikTokin which, according to the complainant, contains expressions that could constitute a violation of the electoral ban during the inter-campaign period.

CONCLUDED INAPPROPRIATE TO ORDER THE WITHDRAWAL

The Commission concluded that it was inadmissible to order the removal of the reported materials, since the danger in the delay that puts the guiding principles of electoral matters at imminent risk is not realised, given that we are currently in the campaign stage, which began on March 1, 2024.

These types of measures seek to immediately and urgently suspend those events or conduct that may affect – imminently – the electoral process or any political-electoral right, in which the substantive resolution is issued that determines its legality or illegality, for example. Therefore, granting an extension for the removal of materials that this authority already considered that, preliminarily, could be illicit, would be contrary to the purpose of the precautionary measures.
