The first trial will be held on the 26th against Kim Hye-kyung, wife of Lee Jae-myeong, leader of the Korean Democratic Party, indicted on charges of violating the Public Official Election Law relating to the 2022 presidential elections.
According to the legal community, on the 20th, the 13th Criminal Division of Suwon District Court (President Park Jeong-ho) set the date of Mr. Kim’s first trial at 2:00 pm on the 26th. On the 14th, the prosecution indicted the Mr. Kim without detention on charges of violating the Official Public Elections (Donation) Law.
Mr. Kim is accused of offering a meal worth 100,000 won to three party-related figures and his driver and lawyer at a restaurant in Seoul on August 2, 2021, after Representative Lee announced his candidacy for the primary of the party.
It turned out that after serving a meal, Mr. Kim asked Mr. Bae, who was a Level 5 government official in the Gyeonggi Province Special Service, to pay for the meal using a Gyeonggi Province company card. The prosecution first indicted Mr. Bae in September 2022, and Mr. Bae was found guilty and sentenced to 10 months in prison and 2 years of probation in the second trial on the 14th.
In Mr. Kim’s first trial, the prosecution is expected to explain the facts of the accusation and the defendant will announce whether or not to admit the charges. It is also expected that discussions will take place on future trial procedures, including the examination of witnesses.
Separately from the election law violation case, the prosecution is conducting an investigation into the suspected misappropriation of the corporate card of the Gyeonggi Provincial Office by Mr. Kim and Mr. Bae (alleged breach of duty). This is a case in which the Anti-Corruption and Civil Rights Commission requested an investigation in October last year, citing strong suspicions that CEO Lee and his wife were misusing company cards.
