Yes. The court did not accept the request for an injunction filed by former CEO Jun-seok Lee, asking to amend the party’s constitution for the transition to a non-proxy system for people’s power and to stop the effect of the Jeong Jin who is delegating on his behalf. -seok.

The court made its decision eight days after the hearing was held on the 28th of last month.

Today (6th) the Seoul Southern District Court rejected all applications for an injunction filed by former President Lee on people’s power, and rejected all applications for the non-commissioned chairman and non-commissioned members.

First of all, the court ruled that it is difficult to see that there is a substantial and procedural defect in the application for the 4th injunction to prevent the effect of the performance of duties by Vice Chairman Jeong Jin-seok.

According to the party’s amended constitution, a national committee was held, and there were no elements that could harm party democracy in the process.

In particular, the court said that the way a political party decides on the organization and powers of a representative body through party constitution is the party’s domain of freedom.

He also said that even if the constitution were to be changed, the party’s intention should be respected provided the content itself does not clearly violate the constitution or the laws or go against the social order.

He also did not recognize the argument that the constitution had been amended to be an ’emergency situation in case of the resignation of four members of the Supreme Council’, which was the logic of the former president, which was a retrospective issue, and he applied the previous situation.

The court ruled that, even under the current circumstances, the resignation of the main members is upheld, and that the vacancy should be considered to continue according to the party’s amended constitution, and that it was not a situation where a post-application was applied .

The court also rejected the request for an injunction to prevent the performance of duties against the non-commissioned members who make up the one who is not captain Jeong Jin-seok based on the same reasoning.

As for the application for the third injunction, which disputed whether the amendment to the constitution was justified, former CEO Lee had already applied for the fourth and fifth injunctions, so it was refused, saying that it is not an area for separate adjudication.

Earlier, on August 26, the court decided that the duties of then-chairman Joo Ho-young should be suspended by partially accepting Lee’s first injunction request.

This time, the court confirmed the hand of the people, and the ‘not captain Jeong Jin-seok’ system could be maintained as it is.
