Driving a lorry towards an acquaintance… Sudden braking admitted, not guilty of attempted murder

(Incheon = Yonhap News) Reporter Son Hyeon-gyu = A driver in his 60s who was accused of trying to kill a middle-aged woman he knew by crashing into a truck was acquitted in court after being found guilty of stepping on the brakes only before the accident.

The 15th Criminal Division of the Incheon District Court (Chief Judge Ryu Ho-joong) announced on the 25th that it had acquitted Mr A (63, male), who was charged with attempted murder.

Mr A was accused of trying to kill his acquaintance B (55, female) with a 1 ton truck in India, Seo-gu, Incheon, on September 22 last year at 5:52 pm.

Mr B, who was hit by a lorry traveling at 18.5 km per hour, fell on a flower bed next to the pavement and suffered serious injuries such as a broken pelvis for 16 weeks.

Mr. B rides in Mr.’s lorry. And before the accident, and after an argument about paying for gas, he got out of the vehicle and walked on the pavement.

The prosecution considered that Mr. A, who was angry with an argument, drove the truck after Mr. B, and then stepped on the accelerator pedal momentarily and rushed.

However, in court, Mr. A, “It is true that I was angry the moment I found Mr. B (in India) driving a truck,” but he insisted, “I was thinking of stopping the vehicle in front of Mr. B, but he an accident.”

The court accepted Mr A’s claim, saying that the lorry’s tail light had turned on to the right before the accident and that there were signs of sudden braking (skid marks) on the road as well.

At the time of the accident, the prosecution presented the soot produced from the exhaust pipe of Mr A’s lorry as the basis for the rapid acceleration of the vehicle, but the court recognized the opinion of an investigator at the Road Traffic Authority that this phenomenon also occurs during sudden braking .

The judge said, “Looking at the defendant’s statement that he was angry at the time, I doubt whether there was an intention to shock Mr. B.”

“(After an argument), after Mr. B got out of the vehicle, the defendant closed the passenger side door himself and checked with the gas station attendant to see if the gas bill had been properly paid ,” he said. It’s hard to see in terms of human behaviour,” he added.
