However, the police are considering what kind of charges to bring against Shin Hye-seong, who was driving someone else’s car while drunk.
At first, theft charges were reviewed, but now the pressure is on charges of unlawful use of vehicles instead of thefts.
Reporter Baek Gil-jong will explain the reason.

Shin Hye-seong, who was driving someone else’s car was parked with the key at the restaurant.

Shin said, “I was drunk and he mistook it for my car.”

The police are considering pursuing the charge of theft, but the problem is proving that the theft was intentional.

In particular, it is said that the substitute driver, who moved with Mr. Shin and a passenger, having stated that he heard each other asking if the car owned by Mr. Shin in the car.

As Shin claims, there is a possibility that he has misplaced his car, but if this situation is confirmed to be true, it will be difficult to apply the theft charges.

– “If the intention to steal the vehicle, ie the intention to ‘acquire it illegally’, is not recognised, it seems difficult to prove the charge of theft.”

Because of this situation, the police are considering implementing the charge of illegal use of vehicles instead of theft.

Unlawful use of a car is a crime that occurs when a car is used without the owner’s permission, even if there was no intention to own it.

The sentence is less than 3 years in prison or a fine of no more than 5 million won, which is half the level of theft.

However, there is an opinion that it is difficult to judge that it is illegal to use a car if you accidentally get into someone else’s car while drunk, so the police are also continuing to investigate Shin’s whereabouts on the day of the event.
